Requirements
for Strict Product Liability
Plaintiff must show product was so “defective” it was “unreasonably
dangerous”:
Ø Product must be
in defective condition when sold.
Ø Defendant is in
the business of selling the product.
Ø Product must be
unreasonably dangerous.
Ø Plaintiff must
be physically harmed
Ø Defective
condition must be proximate cause of injury.
Ø Good are in
substantially same condition.
